Morning Session: Ethics
James Hilditch LLB M Env Law
James Hilditch has been acting for some of Australia’s largest companies, institutions and brands for over 25 years. Hilditch Lawyers are also engaged by other law firms to provide advice and representation in the Courts for their clients within our specialist fields.
James enjoyed teaching within his specialist fields at university for many years. James was also appointed by the Governor as a member of the Architectural Practice Board of South Australia for a number of years. In addition to his Law Degree, James has obtained the qualification of Master of Environmental Law from the University of Adelaide, demonstrating his commitment to our specialist fields of law.
James provides careful and thoughtful guidance to clients who are required to make applications to public bodies such as local Councils, the State Commission Assessment Panel, the Environment Protection Authority and the Native Vegetation Council.
James is able to draw on his significant experience as an advocate before the Courts, the State Commission Assessment Panel and Council Assessment Panels when providing guidance to clients. This experience assists James to identify issues, and more importantly practical solutions, quickly and effectively.
Planning with Integrity: the Role of Ethics in Planning Practice
James Hilditch will explore the way ethical and integrity issues in planning are produced, thought about and brought into effect and how this shapes the development of strategic planning policy, assessment of development and engagement of community and stakeholder interests.
About
This course provides an understanding of the ethical issues surrounding the planning and management of urban and non-urban environments. It is an abridged version of a full-day course which explores the way ethical and integrity issues in planning are produced, thought about and brought into effect and how this shapes the development of strategic planning policy, assessment of development and engagement of community and stakeholder interests. The course will draw attention to a notion of ethics that goes beyond conflict of interest and professional conduct matters to critically examine how certain planning knowledges assume ascendency over others and how the behaviour of planners is shaped through a range of sites both within and outside of the profession.
Learning Outcomes
- The importance of ethical and integrity issues in the practice of planning and production of planning knowledge;
- How particular planning knowledges are valued over others;
- The rights and values of different social groups and non-human nature; and
- the array of sites through which the conduct of planners is shaped and governed.

Recognised by her peers in the prestigious Best Lawyers Australia list and Doyle’s Guide for several years, Victoria is known for her depth of experience, personable nature and ability to provide clear answers to difficult and technical legal questions.
In addition to her demonstrated expertise in planning, building and environmental law, Victoria also assists clients with liquor licensing, natural resources, rates sales and summary procedural matters.
Her reputation as a trusted advisor and has taught Urban Management and Law to graduate planning and architecture university students and she is also widely published in a variety of state and national legal and business publications.
About
This section of the Super PLANET will comprise 2 hours/units of legislative compliance and 1 hour/unit of governance under the PDI Act. Victoria Shute from Kelledy Jones Lawyers will take attendees through the development assessment process from ensuring correct governance structures are in place for relevant authorities, submission and verification of a development application through to representations, referrals determination, conditions, reserve matters, development approvals and certificates of occupancy – a legislative requirement that is highly relevant to planners and planning conditions under the PDI Act. The session will focus on emerging legal issues, case law and key trends in all aspects of development assessment as they relate to planning professionals. This session will be of great benefit to planning professionals working in local government and planning consultancies as well as accredited professional-planning at all levels under the Accredited Professionals Scheme.
