Session Overview:

You want to make changes to an approved development, but can’t decide on whether to lodge a modification application or a new development application for alterations and additions. When could or should you make one form of application over the other? In this seminar, Dentons Australia (Sydney) will present on the legal requirements for making either application, the circumstances in which you might consider going one way over the other, and the benefits or not of making both applications at the same time, by reference to some key caselaw.

Presenters:

Brooke Bradley, Senior Associate, Dentons

Brooke is a Senior Associate in the Planning, Environment and Government team at Dentons. Practising in environment, planning, and local government law since her admission in 2017, Brooke has gained experience in both advisory and litigation settings assisting private individuals, organisations, and local councils in matters relating to residential and commercial development.

Brooke has also been involved in carrying out planning and environmental due diligence for private clients in jurisdictions across Australia for a range of project types, including agribusiness, mining, and renewable energy projects.

Justin Koprivnjak, Special Counsel, Dentons

Justin is Special Counsel in the Planning, Environment, and Government group of Dentons in Sydney. Justin has more than a decade of experience in private practice as a planning, environmental and local government lawyer, including a secondment as Acting General Counsel at North Sydney Council.

Justin advises and appears on various aspects of planning, development, environment, and local government law both front end and back end. His particular areas of expertise include planning and development; associated compliance, due diligence, and planning agreement negotiation; pollution and contaminated land; local government; and all related NCAT, local court and land and environment court litigation.

Justin’s client base is comprised of individual and corporate developers and landholders, but Justin also advises clients within the group, which includes a large metropolitan council. Having acted for both public and private clients alike, Justin has comprehensive insight and understanding of commercial and legal considerations clients take into account in achieving timely and cost effective results, aligned with desired outcomes and objectives.

Stephanie Willis, Senior Associate, Dentons

Stephanie is a Senior Associate in the Planning, Environment and Government team at Dentons, based in Sydney.

Stephanie advises and represents clients in all areas of environment and planning law, including planning assessment and approvals, contaminated land, waste, environmental crime, compulsory acquisition and water law, as well as in real property disputes. She has experience acting in Classes 1, 3, 4 and 5 of the NSW Land and Environment Court, the Real Property List in the NSW Supreme Court and appeals in the NSW Court of Appeal.

Stephanie was formerly tipstaff to Justice Preston, the Chief Judge of the Land and Environment Court. She also has experience working in the litigation team of the former NSW Department of Planning, Industry and Environment.

Liz is a town planner with 25 years' professional experience in urban and regional planning in NSW. Having spent the large part of her career in Local Government, Liz moved to join Elton Consulting in 2016 and has this year founded Eight Mile Planning.

Liz is a passionate planner with expertise across land use policy, strategic and statutory planning working closely with both private and public sector clients.

Based in Mudgee in regional NSW, Liz has a particular interest in regional growth and development and delivering a planning framework which can be tailored and is relevant across the diverse jurisdictions to which it applies.
